Senior Counsel Summary: Based in Bechtel's Reston, Virginia office, this attorney will work as a senior member of the legal team in Bechtel's Civil business unit, which supports civil infrastructure projects worldwide, including in the rail, aviation, hydroelectric and road sectors. The attorney will support civil infrastructure prospects and projects in North America and providing ad hoc support to projects worldwide, all under the direct supervision of the Principal Counsel for Civil, based in London. The role requires coordination in the development of company positions and regular strategic input to management decision making. Key elements of the work are: - Legal analysis and drafting;
- Negotiation;
- Ability to develop creative, business-oriented solutions; and
- Ability to communicate effectively with internal and external clients and stakeholders.
- The work is typically complex and demanding by reason of its value, commercial significance to the company, tight timescales and technical content.
- The candidate will show strong legal, management and communication skills and be capable of working with minimal supervision while welcoming senior level involvement in their work and maintaining a regular flow of information to those needing it.
Work Profile: Provide business-oriented legal support for projects in execution, including: - Proactive support of project management, engineering, procurement and construction professionals working under deadline;
- Identification and communication to senior management of project-specific issues that may have company-wide significance;
- Early management of potential claims from and against clients and subcontractors which arise during project execution;
- Close coordination with in-house and external subject matter experts to identify and resolve emergent situations and risk exposures; and
- Negotiation, resolution and documentation of contract amendments, change orders, settlement agreements and other binding instruments.
- Provide business-oriented legal support for prospects, including:
- Review of requests for qualification, requests for proposal, and associated contract documents;
- Coordination with senior representatives in business development, financial, risk management, engineering and labor relations groups to develop positions regarding risk allocation and contract terms;
- Negotiating contract terms with clients, joint venture partners, and critical subcontractors and suppliers;
- Development of risk mitigation strategies related to legal, contractual and execution risks; and
- Review of pre-qualification and proposal documents to ensure accuracy, consistency and compliance with legal requirements.
- Coordination and support of internal legal and corporate housekeeping functions;
- Coordination with other members of corporate legal and risk management team, including:
- Coordination with lawyers, risk management and claims professionals regarding claims, litigation and other legal proceedings;
- Coordination with internal and external subject matter experts to support other functions, such as human resources, engineering, procurement and labor relations;
- Coordination with lawyers in other business units to develop and maintain consistent positions on like issues.

Qualifications: - Professionally qualified lawyer; law or other degree from recognized US university or college with excellent academic credentials; and requisite State Bar professional qualification as attorney.
- Continuing membership of State Bar.
Experience: - At least ten to twelve years post qualification experience either as in-house counsel or with a nationally recognized law firm, including specific focus on preparation and negotiation of complex contractual documents.
- Several years of first-chair experience negotiating complex contracts.
- Experience in engineering and construction industry is important.
- Experience and familiarity with the following are preferred:
- the civil infrastructure sector, ideally in North America;
- various procurement models, including public private partnership (P3), design-build (DB), design-build-finance (DBF), design-build-finance-operate-maintain (DBFOM), and design-bid-build;
- various contract types, scopes and associated risk profiles, including project management; design-build; engineering, procurement and construction management (EPCM); and engineering, procurement and construction (EPC);
- funding mechanisms and associated constraints/contract terms in the US infrastructure sector, including FRA and FHWA funding, required federal contract provisions, and applicable federal laws and regulations;
- various forms of joint associations and associated documentation, including contractual joint ventures (both integrated and non-integrated), limited liability companies, and exclusive subcontractor arrangements.
Other Skills - IT Skills: Strong ability to use standard professional office applications, including Word, Excel and PowerPoint.
- Foreign language ability and strong cultural awareness are highly valued.
