Summary of Role: SunPower is seeking a Contracts Management, Administration, and Compliance Manager for Engineering, Procurement and Construction (EPC) to provide strategic and organizational leadership to the Contracts Management, Administration, and Compliance Group. The Contracts Management, Administration, and Compliance Manager reports to the Director of Project Controls within the EPC Organization and will be responsible for driving the management and administration of our project contracts, establishing and monitoring strategic objectives for those projects, staffing, budgeting, training, outsourcing, and facilitating high-level negotiations with customers and partners within the contracts environment and customer relations arena.

ESSENTIAL DUTIES AND RESPONSIBILITIES (other duties may be assigned):

• Provides strategic and organizational leadership to the Contracts Management, Administration, and Compliance Group including:
  • Establishing, monitoring and implementing long-term strategic objectives aligned with Corporate goals
  • Manage staff and develop scalable staffing models (both in-house and outsourced)
  • Manage departmental budget and staff training requirements
  • Develop scalable and cost effective business processes and systems required to manage operations based across multiple geographies (onshore and offshore), instilling LEAN philosophies into all aspects of operations.
  • Define and manage quarterly and annual group and staff key performance objectives and metrics that address and execute organizational goals, cost, and operational efficiencies

  • Develop and implement robust contracts management philosophy and methodology into corporate organizational structure to include process and procedure development and customization, implementation, and utilization of automated contracts management tools
  • Facilitate and/or lead high-level negotiations with customers and suppliers
  • Interface with Legal and applicable internal stakeholders on outstanding contractual matters to include execution and enforcement of executed contractual obligations and resolution of claims, disputes and change orders
  • Monitor and enforce contractual compliance as established within the confines of executed contracts to include milestone, deliverable and completion achievement, proper invoicing and payment requirements, insurance and licensing obligations and all local, state and federal compliance obligations
  • Maintain contractual records and documentation such as contractual correspondence, contract changes/amendments, warranties other documents as identified in executed contracts
  • Manage and ensure proper project open processes and procedures are followed
  • Ensure contract close-out, extensions and renewals are executed properly• •
  • Manage and ensures all required SunPower and partner licenses are valid and maintained as necessary to conduct business.
Manage accounts receivable and accounts payable processes and procedures in order to ensure timely customer billing and supplier payments•
Minimum Requirements:
  • Bachelor's degree or 4 years related work experience.
  • 10 years progressive commercial construction administration experience in a Design-Build and EPC environment

  • • Expert in managing multiple complex contracts concurrently
  • Expert understanding of prevailing wage, OSHA, and workers comp compliance requirements
  • Expert understanding of vendor lien mechanics and insurance requirements, and notices of completion.
Strong working knowledge of project bonding, construction project lifecycle and local, state, federal, and other requirements including but limited to DVBE, Davis-Bacon Act, and AIA Master's degree
•Experience managing a large multi-location team
  • Strong working knowledge of project labor agreements and management of union/non-union labor exposure on construction projects
Excellent administrative and organizational skills
• •Strong working knowledge of complex billing and payment schedules.

•Experience working with ERP (Oracle), CRM (SalesForce), other enterprise construction management tools like e-builder and Primavera P6*LI-TJ
